| Abstrak | Penelitian ini dilatarbelakangi dengan meningkatnya jumlah anak berhadapan hukum sebagai pelaku kekerasan di Kabupaten Banyumas, yang di dominasi dengan bentuk kekerasan seperti pencurian, kekerasan seksual dan kekerasan fisik (penganiyaan/pengeroyokan). Dengan diterapkannya kebijakan Kabupaten Layak Anak di Kabupaten Banyumas, pemenuhan hak perlindungan khusus dengan keadilan restoratif melalui mekanisme diversi bagi anak berhadapan hukum juga menjadi perhatian khusus bagi pelaksana dalam Tim Gugus Tugas KLA. Lokasi penelitian di Kabupaten Banyumas. Tujuan dari penelitian ini adalah untuk mendeskripsikan proses implementasi dan menganalisis faktor yang mempengaruhi kebijakan Kabupaten Layak Anak dalam pemenuhan hak perlindungan khusus bagi anak berhadapan hukum di Kabupaten Banyumas. Metode penelitian yaitu pendekatan kualitatif deskriptif. Pemilihan informan menggunakan teknik purposive sampling. Metode analisis yang digunakan adalah interaktif. Keabsahan data diuji dengan triangulasi sumber. Hasil penelitian menunjukkan bahwa implementasi kebijakan KLA dalam pemenuhan hak perlindungan khusus bagi anak berhadapan hukum di Kabupaten Banyumas belum optimal. Hal ini diindikasikan dengan jumlah penyelesaian kasus anak berhadapan hukum melalui pendekatan restorative justice belum meningkat, cenderung jumlahnya bersifat fluktuatif dari tahun ke tahun. Hasil penelitian menunjukkan belum optimalnya implementasi kebijakan KLA juga dipengaruhi oleh faktor sumber-sumber, meliputi sumber daya manusia, minimnya anggaran di beberapa instansi, adanya tumpang tindih kewenangan antara PPT-PKBGA dan Pekerja Sosial, dan belum tersedianya fasilitas pusat rehabilitasi, shelter, LPKA dan Balai Latihan Kerja. Dalam aspek komunikasi, informasi mengenai kebijakan KLA masih kurang jelas dan mendetail. Dalam aspek struktur birokrasi belum adanya regulasi khusus terkait dengan pelaksanaan KLA di Kabupaten Banyumas. Meskipun ketiga faktor tersebut mempengaruhi belum optimalnya implementasi, akan tetapi aspek disposisi menunjukkan hasil yang cukup baik. |
| Abstrak (Inggris) | The background of this research is by the increasing number of children in conflict with the law as perpetrators of violence in Banyumas Regency, which is dominated by violence such as theft, sexual violence and physical violence (persecution/beating). With the implementation of the KLA policy in Banyumas Regency, the fulfillment of special protection rights with restorative justice through the diversion mechanism for children against the law is also of special concern to the implementers in the KLA Task Force Team. The location of this research is in Banyumas Regency. The purpose of this research is to describe the implementation process and analyze the factors that influence the policy of Children Friendly City in the fulfillment of special protection rights for children in conflict with the law in Banyumas Regency. The research method used is descriptive qualitative approach. Selection of informants using purposive sampling technique. The analytical method used is interactive. The validity of the data is tested by source triangulation. The results showed that the implementation of the KLA policy in the fulfillment of special protection rights for children in conflict with the law in Banyumas Regency has not been optimal. This is indicated by the number of settlement cases of children in conflict with the law through restorative justice approach has not increased, tends to fluctuate in amount from year to year. The results of the research indicate that policy has not been optimal and is affected by sources, including human resources, lack of budget in some agencies, overlapping authority between PPT-PKBGA and Social Worker, and unavailability of rehabilitation center facilities, shelter, LPKA and Training Center. In the communication aspect, information on KLA policy is still unclear and detailed. In the aspect of bureaucratic structure there is no specific regulation related to KLA implementation in Banyumas Regency. Although these three factors affected the unoptimal implementation, but the disposition aspect shows a good results. |
