| Abstrak | KUHAP (Kitab Undang-Undang Hukum Acara Pidana) yang menjunjung tinggi harkat dan martabat manusia kiranya dapat memberikan penghayatan bagi aparat penegak hukum untuk menghormati hak tersangka dalam pelaksanaan proses penyidikan hingga pembuktian ke arah tegaknya hukum demi keadilan dan kepastian hukum. Melihat semakin meningkatnya jumlah anak berhadapan dengan hukum, maka terdapat perbedaan proses dan teknik penyidikan antara orang dewasa dengan anak sesuai dengan Psikologi Hukum. Adapun tujuan penulisan skripsi ini adalah untuk mengetahui apakah pelaksanaan psikologi hukum dalam proses penyidikan anak berhadapan dengan hukum telah sesuai serta apa saja yang menjadi kendala tersebut. Metode penelitian yang digunakan adalah yuridis sosiologis, spesifikasi penelitian adalah deskriptif, sumber data yang digunakan adalah data primer dan data sekunder, metode pengumpulan data adalah wawancara dan studi kepustakaan, serta metode analisis data menggunakan kualitatif. Pelaksanaan psikologi hukum dalam proses penyidikan anak berhadapan dengan hukum di Unit PPA Polres Banyumas telah berjalan dengan baik sesuai dengan peraturan yang berlaku meskipun mengalami beberapa kendala dalam proses penyidikan anak, namun demikian dalam praktiknya terdapat upaya untuk mengatasi kendala tersebut. |
| Abstrak (Inggris) | Criminal Code Procedures which uphold the dignity and prestige of human being have given guidance to the law enforcer to grant the rights of the suspect from the investigation process until the result of law enforcement for the sake of justice and legal security. By the increase of the number of child suspects, need to be understood that there are differences on investigation process and technique between adults and child suspects according to Legal Psychology. Therefore, purpose of this thesis is to understand whether the implementation of legal psychology in the investigation process of child offenders has been appropriate or not and what are the obstacles. Research method that is used in this research is juridical sociologist, while the research specification is descriptive. The data of this research are sourced from primary data that is obtained from interview and secondary data that is obtained from literature review. This research is using qualitative method for the analysis. Implementation of legal psychology in the investigation process of child suspects in the PPA Unit of Banyumas Departmental Police has gone well and has complied with the rules. Even though there are some obstacles in the process, but some attempts have been done to resolve them. |
