| Abstrak | Perkembangan ekonomi suatu negara sangat dipengaruhi oleh para pelaku ekonomi, baik yang dilakukan secara perorangan maupun badan usaha. Perusahaan sebagai salah satu pelaku ekonomi memiliki beberapa peranan seperti, penciptaan lapangan pekerjaan, produksi barang dan/atau jasa, sumber pendapatan negara. Berdasarkan peran tersebut perusahaan harus melaksanakan kewajiban suatu tanggung jawab sosial dan lingkungan atau disebut sebagai Corporate Social Responsibility (CSR) yang selanjutnya diatur dalam Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas guna ikut berperan dalam memberikan kontribusinya kepada masyarakat maupun lingkungan. Metode penelitian yang digunakan adalah metode penelitian hukum yuridis normatif dengan spesifikasi penelitian menggunakan penelitian deskriptif serta menggunakan sumber data sekunder berupa peraturan perundang-undangan dan teori hukum serta didukung dengan data primer melalui wawancara di kantor pusat PT. Mulia Agro Permai, dengan model penyajian data menggunakan bentuk teks naratif dan model analisis data secara normatif kualitatif. Berdasarkan hasil penelitian, dapat disimpulkan bahwa perspektif masyarakat mengenai perusahan kelapa sawit merusak lingkungan adalah salah, karena PT. Mulia Agro Permai telah melaksanakan kegiatan CSR sesuai dengan peraturan perundang-undangan yang berlaku yakni Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas mengenai Tanggung Jawab Sosial dan Lingkungan. Pelaksanaan program CSR ini dilakukan pada beberapa sektor yaitu, education, community, environment, dan employees. |
| Abstrak (Inggris) | The development of the economy of a country is strongly influenced by the economic actors, whether conducted by individuals or businesses. Company as one of the economic actors have some role such as, job creation, the production of goods and/or services, the source of income of the country. Based on the role the company should carry out an obligation of social responsibility and the environment or referred to as Corporate Social Responsibility (CSR) which is further stipulated in Article 74 of Law No. 40 Year 2007 on Limited liability Company in order to participate in contributing to the community and the environment. The research method used is the method of legal research is normative juridical with the specification of the research use descriptive research and use secondary data sources in the form of legislation and legal theory and supported by primary data through interviews in the office PT. Mulia Agro Permai, with a model of presentation of data using a form of narrative text and data analysis models for normative qualitative. Based on the research results, it can be concluded that the perspective of the society for oil palm companies destroying the environment is wrong, because PT. Mulia Agro Permai has been carrying out CSR activities in accordance with the regulations of the applicable legislation, namely Article 74 of Law No. 40 Year 2007 on Limited liability Company regarding the Social and Environmental Responsibility. The implementation of CSR programs is done in a few sectors, namely, education, community, environment, and employees. |
