| Abstrak | sengketa antara Pegawai Negeri Sipil dengan Kepala Badan Kepegawaian dengan dikeluarkannya Keputusan Nomor 14899/KEP/BV/14004/09 Tentang Pemberhentian Dengan Hormat Sdr Abdurrochman Sebagai Panitera Pengganti Pengadilan Agama Kebumen Karena Memasuki Batas Usia Pensiun, oleh Kepala Badan Kepegawaian Negara yang belum disesuaikan dengan Undang-undang nomor 50 Tahun 2009 tentang Peradilan Agama yang mengatur Batas Usia Pensiun bagi Panitera Pengganti mengalami perubahan. Permasalahan yang akan dilihat dalam penelitian ini adalah Bagaimanakah Upaya Administratif Terhadap Keputusan Kepala Badan Kepegawaian Negara Nomor 14899/KEP/BV/14004/09 Tentang Pemberhentian Dengan Hormat Sdr Abdurrochman Sebagai Panitera Pengganti Pengadilan Agama Kebumen Karena Memasuki Batas Usia Pensiun. Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif yaitu pendekatan dari sudut pandang ketentuan hukum atau peraturan perundang-undangan yang berlaku, karena untuk melakukan penelitian ini mengacu pada peraturan-peraturan yang berlaku yaitu UU Pokok-pokok Kepegawaian, UU Peradilan Agama, PP Pemberhentian PNS, Keputusan BKN. Setelah melaksanakan penelitian, telah didapatkan hasil bahwa Upaya Administrasi yaitu ”Upaya KEBERATAN” yang dilakukan oleh Abdurrochman sebagai Panitera Pengganti Terhadap Kepala Badan Kepegawaian Negara untuk meninjau Keputusan tentang Pemberhentian PNS karena memasuki BUP atau Pensiun dapat dikabulkan dengan pertimbangan Pasal 38 A huruf d UU Peradilan Agama yang mengatur BUP mengalami perubahan menjadi 60 (enam puluh) tahun yang sebelumnya 56 (lima puluh enam) tahun yang diatur dalam PP Pemberhentian PNS, kemudian Kepala BKN mengeluarkan Keputusan baru yang membatalkan Keputusan terdahulu yang menjadikan dasar bagi Abdurrochman untuk aktif kembali dan memamngku jabatan Panitera Pengganti di Pengadilan Agama Kebumen. |
| Abstrak (Inggris) | Like the case between the civil servant and the head of civil service board indicated by issue of Decision No:14899/Kep/BV/14004/09 about the honorable cessation of Abdurrochman as Substitute Clerk of Kebumen Islamic Court published by the Head of Civil service board which was not suitable with the Article No 05/2009 about the Religious Court regulating the limit of retirement age for the Substitute Clerk. The problem which would be analyzed in this research was how was The Administrative Effort towards the Decision of the Head of the National Board of Civil Service No:14899/Kep/BV/14004/09 about the honorable cessation of Abdurrochman as the Substitute Clerk of Kebumen Islamic Court because of his age. This research was conducted through juridical normative approach focusing on the approach of law enforcement of regulation because this research was based on the Law of Civil Service, Law of Religious Court, Government Regulation of Civil servant cessation, and BKN decision. After the research was done, it was found that the administrative effort which was about Objection Effort proposed by Abdurrochman as the substitute clerk towards the Head Civil Service Board to review the decision of civil servant cessation because of the age or retirement was granted. The considerations were in line with the Article 38 A letter d of the Law of Religious court which stated that BUP set has been changed into 60 (sixty) years prior the retirement age was 56 (fifty-six) regulated in Government Regulation about Civil Servant Cessation. Then, the head of the civil service board issued the new decision to cancel the previous decision. By this, Abdurrochman was reappointed the Substitute clerk of the Kebumen Religious Court. |
