| Abstrak | ABSTRAKSI Pada dasarnya setiap bentuk dan jenis perusahaan pasti mempunyai hubungan yang erat dengan masyarakat di sekitarnya. Apalagi perusahaan yang berbentuk perseroan terbatas yang kegiatan usahanya bergerak di bidang atau berkaitan dengan sumber daya alam. Ketika perusahaan tidak dapat menjaga hubungan tersebut, maka tidak jarang akan memicu terjadinya konflik. Mengingat besarnya dampak yang ditimbulkan, maka pemerintah berusaha menjaga hubungan antara perusahaan dengan masyarakat yang ada di sekitarnya dengan mengeluarkan peraturan mengenai Tanggung Jawab Sosial dan Lingkungan (TJSL) dalam Pasal 74 Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas (UUPT). Penelitian ini merupakan penelitian yuridis normatif yang bertujuan untuk mengetahui penerapan TJSL di PT. Holcim Indonesia Tbk. pabrik Cilacap. PT. Holcim Indonesia Tbk. pabrik Cilacap, sebagai perusahaan yang berbentuk perseroan terbatas dan bergerak di bidang sumber daya alam, tunduk pada Pasal 74 ayat (1) UUPT, sehingga wajib melaksanakan TJSL, dimana dalam hal ini pelaksanaannya bertempat di Kabupaten Cilacap, Jawa Tengah. Kemudian terkait dengan biaya yang diperlukan, maka perusahaan ini tunduk pada Pasal 74 ayat (2) UUPT. Perusahaan tersebut harus menganggarkan dan memperhitungkan biaya TJSL sebagai biaya perusahaan, dimana pelaksanaannya berdasarkan kepatutan dan kewajaran. Pemerintah tidak mengatur mengenai tata cara pelaksanaan TJSL, sehingga setiap perusahaan dapat dengan leluasa melaksanakan TJSL sesuai dengan kebijakan perusahaan tersebut. Dalam hal ini, PT. Holcim Indonesia Tbk. pabrik Cilacap menyerahkan pelaksanaan TJSL pada bagian Community Relations (Comrel) dan dilaksanakan dengan cara bermitra dengan pihak lain yaitu dengan melibatkan Pemerintah Daerah setempat dan Universitas Jenderal Soedirman. |
| Abstrak (Inggris) | ABSTRACT Basically every form and type of company must have a relation with the society around it. Moreover, the company in the form of limited company which its activities engaged in business activities or related to natural resources. When the company was unable to maintain a good relationship, it is not uncommon to be triggered some conflict. Given the magnitude of the impact inflicted, then the Government tried to keep the relationship between the company and neighboring communities by issuing rules about Social and Environmental Responsibility in Article 74 of Law Number 40 Year 2007 about Limited Company. This research is the juridical normative reaserch aims to know the application of Social and Environmental Responsibility in PT. Holcim Indonesia Tbk. Cilacap Plan. PT. Holcim Indonesia Tbk. Cilacap Plan, as the limited company which it activities in the field of natural resources, subject to Article 74, paragraph (1), of Law Number 40 Year 2007 about Limited Company, so it is obligated to carry out the Social and Environmental Responsibility, where in this case implementation housed in Cilacap Regency, Central Java. Then associated with the required fee, these companies are subject to Article 74, paragraph (2), of Law Number 40 Year 2007 about Limited Company. The companies have to spends and takes into account the cost of Social and Environmental Responsibility as the cost of the company, in which its implementation based on propriety and reasonableness. The Government is not governing the procedures for the implementation of Social and Environmental Responsibility, so that each company can freely carry out in accordance with the company policy of Social and Environmental Responsibility. In this case, PT. Holcim Indonesia Tbk. Cilacap Plan, handed Social and Environmental Responsibility implementation to Community Relations (Comrel) and its implemented by the other party in partnership with the regional government and the University of Jenderal Soedirman. |
