| Abstrak | ABSTRAK Informasi dan transaksi elektronik sangat mudah diperoleh menggunakan sistem elektronik berupa komputer dan internet. Hal ini memberikan dampak semakin banyak tindak pidana menggunakan teknologi khususnya tindak pidana pornografi. Alat bukti informasi dan transaksi elektronik dapat dijadikan alat bukti baik dalam tingkat penyidikan, penuntutan, dan pemeriksaan di sidang pengadilan. Adapun tujuan dari penelitian yang dilakukan oleh penulis adalah untuk mengetahui alat bukti informasi dan transaksi elektronik dijadikan pertimbangan hukum hakim terhadap dalam kasus Ariel Peterpan berdasarkan Putusan Nomor 1401/Pid.B/2010/PN.Bdg dan untuk mengetahui kesesuaian alat bukti informasi dan trasaksi elektronik dalam kasus Ariel Peterpan dengan alat bukti yang terdapat dalam Pasal 184 KUHAP berdasarkan Putusan Nomor 1401/Pid.B/2010/PN.Bdg. Penulisan ini menggunakan pendekatan yuridis normatif, data yang digunakan merupakan data sekunder yang diperoleh melalui studi kepustakaan yang kemudian diolah, disajikan, dan dianalisis secara kualitatif dan merupakan titik berat penelitian ini, sedangkan data primer diperoleh melalui wawancara dengan hakim di Pengadilan Negeri Bandung, dimana data primer digunakan sebagai data pendukung. Berdasarkan hasil penelitian pada Putusan Nomor: 1401/Pid.B/2010/PN.Bdg alat bukti informasi dan transaksi elektronik dijadikan pertimbangan hukum hakim dalam kasus Ariel Peterpan, hakim memperoleh keyakinan berawal dari alat bukti informasi dan transaksi elektronik video pornografi menyebar. Alat bukti informasi dan transaksi elektronik berdasarkan Pasal 5 ayat (1) dan (2) jo. Pasal 44 huruf a dan b Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik merupakan alat bukti yang sah karena merupakan perluasan dari alat bukti dalam Pasal 184 KUHAP atau alat bukti informasi dan transaksi elektronik merupakan aturan khusus, sedangkan KUHAP merupakan aturan yang bersifat umum (Lex Specialis Derogat Legi Generali). | Abstrak (Inggris) | ABSTRACT Information and electronic transaction is very easy to be obtained by using the electronic system such as computer and internet. This gives the impact and produces many of criminal act by using the technology especially criminal act of pornography. The evidence tool of information and electronic transaction can be an evidence tool in the investigation level, prosecution, and examination in the trial. And the purpose of this research that was conducted by the writer is to find out the evidence tool of information and electronic transaction to be the consideration of judge law like in the case of Ariel Peterpan based on the Decision Number 1401/Pid.B/2010/PN.Bdg and to find out the appropriateness the evidence tool of information that written in the Article 184 KUHAP based on the Decision Number 1401/Pid.B/2010/PN.Bdg. This writing uses the approach of normative juridical, data uses the secondary data that has been obtained through the literature study and then managed, presented, and analyzed qualitatively and it is the heaviest part in this research, and the primary data was obtained through the Interview with the judge in the Public Court Bandung, where the primary data that in this research used as the support data. Based on the result of research in the Decision Number: 1401/Pid.B/2010/PN.Bdg that the evidence tool of information and electronic transaction become the law consideration of judge in the case of Ariel Peterpan, the judge obtained the conviction that begin with the evidence tool of information and electronic transaction of distribution of pornography video. The evidence tool of information and electronic transaction based on the Article 5 (1) and (2) jo. Article 44 letter a and b Ordinance Number 11, 2008 About Information And Electronic Transaction in the Article 184 KUHAP or evidence tool of information and electronic transaction is the specific regulation, and KUHAP is the regulation that has the general characteristic (Lex Specialist Derogat Legi Generali).
