| Abstrak | ABSTRAK Penelitian ini berjudul “Izin Poligami Bagi Pegawai Negeri Sipil Menurut Peraturan Pemerintah Nomor 45 Tahun 1990 di Kabupaten Banyumas”. Tujuan penelitian ini adalah untuk mengetahui izin Pegawai Negeri Sipil yang akan beristeri lebih dari seorang dan untuk mengetahui akibat hukum dari Pegawai Negeri Sipil yang beristeri lebih dari seorang. Pegawai Negeri Sipil sebagai unsur aparatur negara, abdi negara dan abdi masyarakat haruslah menjadi teladan yang baik bagi masyarakat dalam tingkah laku, tindakan dan ketaatan terhadap peraturan perundang-undangan yang berlaku. Kehidupan Pegawai Negeri Sipil harus ditunjang oleh kehidupan berkeluarga yang serasi sehingga setiap Pegawai Negeri Sipil dalam melaksanakan tugasnya tidak akan banyak terganggu oleh masalah-masalah dalam keluarga, misalnya permasalahan dalam perkawinan poligami. Pegawai Negeri sipil yang akan beristeri lebih dari seorang diatur didalam Peraturan Pemerintah Nomor 45 Tahun 1990 tentang Perubahan Atas Peraturan Pemerintah Nomor 10 Tahun 1983 tentang Izin Perkawinan dan Perceraian Bagi Pegawai Negeri Sipil. Peraturan Pemerintah tersebut berlaku sepanjang tidak bertentangan dengan Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan.Petunjuk pelaksana dalam hal izin beristeri lebih dari seorang bagi Pegawai Negeri Sipil adalah Surat Edaran Kepala Badan Admiistrasi Negara Nomor 48/SE/1990. Adapun Surat Edaran Kepala Badan Administrasi Negara Nomor 8/SE/1983 masih berlaku sepanjang tidak bertentangan dengan ketentuan dalam Peraturan Pemerintah Nomor 45 Tahun 1990. Pegawai Negeri Sipil yang melanggar ketentuan di dalam Peraturan Pemerintah Nomo 45 Tahun 1990 akan dikenakan sanksi berupa hukuman disiplin berat yang terdapat di dalam Peraturan Pemerintah Nomor 53 Tahun 2010 tentang Peraturan Disiplin Pegawai Negeri Sipil. | Abstrak (Inggris) | ABSTRACT Tie research entitled “The Polygamy Permit For Civil Servant According To Government Regulations No. 45 Year 1990 in Banyumas". The purpose of this study was to determine the permit of Civil Servant which is will have polygamy and to know the legal consequences of civil servants who have more than one wife. The Civil Servant as an element of state officials, civil servants and public servants should be good role models for the community in behavior, actions and compliance with laws and regulations. Civil life should be supported by a harmonious family life so that every civil servant in carrying out their duties will not be much bothered by the problems in the family, such as problems in polygamous marriages. Civil Servant which is will have polygamy was regulated in Government Regulation No. 45 Year 1990 on Amendment to Government Regulation No. 10 Year 1983 on the Licensed Marriage and Divorce for Civil Servants. Government regulations are valid as long as not contrary to the Act No. 1 of 1974 on Marriage. Executing instructions in the event of more than one wives permission for Civil Servants is the Circular Letter of the Head of the State Administration number 48/SE/1990. The Circular Letter of the Head of the State Administration number 8/SE/1983 is still valid as long as not contrary to the provisions of Government Regulation No. 45 Year 1990. Civil servants who violate the provisions of the Government Regulation Number 45 Year 1990 will be subject to penalty in the form severe disciplinary contained in the Government Regulation No. 53 of 2010 on Civil Servants Disciplinary Regulations.
