| Abstrak | ABSTRAK Sebagaimana telah diamanatkan dalam Undang-Undang Nomor : 13 Tahun 2003 tentang Ketenagakerjaan Pasal 88 ayat (2), bahwa untuk mewujudkan penghasilan yang memenuhi penghidupan yang layak bagi kemanusiaan, Pemerintah menetapkan kebijakan pengupahan yang melindungi pekerja/buruh. Dalam penetapannya Pemerintah melibatkan para pekerja/buruh melalui Serikat Pekerja/Buruh dan Pengusaha melalui Asosiasi Pengusaha Indonesia (APINDO). Metode pendekatan dalam penelitian ini adalah yuridis normatif atau Legal Research, yaitu pendekatan yang menggunakan konsepsi Legistis Positivis. Konsep ini mengungkapkan, bahwa hukum identik dengan norma-norma tertulis yang dibuat dan diundangkan oleh lembaga atau pejabat negara yang berwenang. Konsep ini, hukum melihat sebagai system normative yang bersifat otonom, tertutup dan terlepas dari kehidupan masyarakat. Spesifikasi penelitian yang digunakan adalah deskriftif analitis yaitu penelitian yang menggambarkan keadaan objek yang akan diteliti untuk kemudian dianalisis berdasarkan teori-teori hukum dan praktik pelaksanaan hukum positif yang menyangkut permasalahan. Prosedur penetapan Upah Minimum telah ditetapkan melalui Peraturan Menteri Tenagakerja dan Transmigrasi Nomor 13 Tahun 2012 tentang Komponen dan Pelaksanaan Tahapan Pencapaian Kebutuhan Hidup Layak. Dengan acuan Peraturan tersebut maka selanjutnya Gubernur menetapkan Upah Minimum. Pemerintah menetapkan upah minimum berdasarkan kebutuhan hidup layak dan dengan memperhatikan produktivitas dan pertumbuhan ekonomi. Dalam menetapkan tahapan pencapaian kebutuhan hidup layak, Gubernur memperhatikan kondisi pasar kerja, usaha yang paling tidak mampu di Provinsi/Kabupaten/Kota serta sara dan pertimbangan dari Dewan Pengupahan. Proses penetapan upah minimum di Kabupaten Ciamis adalah sudah sesuai dengan peraturan perundangan-undangan yang berlaku tentang upah minimum. | Abstrak (Inggris) | ABSTRACT As have been commended in Constitution Number : 13 Year 2003 about employee Section 88 sentence (2), thet to realize production fulfilling competent subsistence to is human, Government specify policy of remunerating protecting worker/labour. In its stipulating of Government entangle all worker/labour trough Federally of Worker/Entrepeneur and labour trough Association Entrepeneur Of Indonesia (APINDO). Approach method in this research uses normative juridical or legal research, it is the approach that uses conception of legistis positivis. This concept reveals that the law is identical with the written norms that made and institutionalized by institution or authorized nation officer. The concept of this sees as the normative system that has autonomous characteristic, closed, and separated from the social life. Research specification uses the analytical descrivetive that is the research which describes the object situation which will be the researched and the analyzed based on the theory of law and implementation practical of positive law that related to the problem. Procedure stipulating of Minimum Wage have been specified in Regulation of Minister of Human Resource and Transmigration Number 13/2013 about Component and Execution Of Step Attainment Of Requirement Of Competent Life. With the Regulation reference hence hereinafter Governor specify Minimum Wage. Government set minimum wages based on the needs of decent living and having regard to productivity and economic growth. In setting the stage of achieving decent living needs, the Governor consider the condition of the labor market, most businesses can not afford in the province/ county / city ass well as advice and consideration of the Remuneratio. The determination process of minimum wage counties in Ciamis counties is in compliance with laws and regulations that applicable minimum wage.
