| Abstrak | Penelitian ini bertujuan untuk mengetahui struktur organisasi, kedudukan, fugsi, tugas dan wewenang Tentara Nasional Indonesia dan Kepolisian Negara Republik Indonesia berdasarkan Pasal 30 ayat (5) UUD 1945. Adapun metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, dengan spesifikasi penelitian deskriptif, sedangkan sumber bahan hukum dalam penelitian ini meliputi bahan hukum primer dan bahan hukum sekunder yang dikumpulkan dengan cara melakukan studi kepustakaan dan studi dokumen serta dianalisis menggunakan metode normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, maka dapat disimpulkan bahwa struktur organisasi TNI terdiri atas Markas Besar TNI yang membawahkan Markas Besar TNI Angkatan Darat, Markas Besar TNI Angkatan Laut, dan Markas Besar TNI Angkatan Udara, kedudukan TNI di bawah Presiden, fungsi TNI sebagai penangkal terhadap setiap bentuk ancaman bersenjata dan tugas pokok serta wewenang TNI adalah menegakkan kedaulatan negara. Sedangkan struktur organisasi Kepolisian Negara Republik Indonesia disusun secara berjenjang dari tingkat pusat sampai tingkat daerah, berkedudukan di bawah Presiden, tugas pokok dan fungsi dalambidang pemeliharaan keamanan. ketertiban masyarakat, dan penegakan hukum. Sedangkan kewenangannya mencakup kewenangan umum Kepolisian Negara dan kewenangan Kepolisian Negara dalam proses pidana yang mencakup tindakan penyelidikan dan penyidikan. |
| Abstrak (Inggris) | This research aims to find out the organization structure, position, function, duty and authority of National Army of Indonesia and Police of Republic Indonesia based on the Article 30 (5) 1945 Constitution. And the method of approach in this research uses the approach of normative juridical, by specification of descriptive research, and the source of material law in this research involves the material of primary law and material of secondary law that collected by doing the literature study and study of documentation and analyzed by using the method of normative qualitative. Based on the result of research and discussion, it can be concluded that the organization structure of TNI consists of Main Headquarter TNI that consists of the Main Headquarter of TNI Ground Force, Main Headquarter of TNI Naval, and Main Headquarter of Air Force, the position to TNI is under the President Position, the function of TNI as the rejecter to every threat with weapon and main duty and authority of TNI is to enforce the national sovereignty. And the organization structure of Indonesian Police is arranged in order star from the central level to the regional level, the police position is under the position of President, the main duty and function in the filed of security preservation, the public orderliness and the law enforcement. And the authority involves the general authority of Indonesia Police and the authority of Indonesia Police in the process of criminal that involves the act of investigation and survey. |
