| Abstrak | Setiap orang mempunyai ide atau gagasan dari setiap karya yang diciptakan. Suatu ciptaan tersebut berhak untuk mendapatkan perlindungan, baik dari segi moral maupun ekonominya. Perlindungan yang diberikan oleh Undang-Undang nomor 19 tahun 2002 tentang hak cipta diberikan pada saat ciptaan tersebut lahir atau selesai diciptakan, berdasarkan pada sistem deklaratif yang dianut oleh hak cipta bahwa perlindungan hak cipta lahir secara otomatis setelah suatu ciptaan dilahirkan, karena siapa yang menciptakan ciptaan terlebih dahulu maka dialah sebagai penciptanya (first to born). Penelitian ini bertujuan untuk mengetahui penerapan Pasal 35 ayat (4) jo Pasal 36 Undang-Undang Nomor 19 Tahun 2002 tentang Hak Cipta dalam putusan nomor 658/K/PDT.SUS/2012. Guna mencapai tujuan tersebut maka penelitian ini dilakukan dengan menggunakan pendekatan yuridis normatif. Data sekunder yang terkumpul kemudian diolah, disajikan, dan dianalisa secara kualitatif dengan penyajian data teks naratif. Hasil penelitian menyatakan bahwa sistem deklaratif dalam hak cipta bersifat fakultatifyaitu seseorang boleh mendaftarkan ciptaannya atau tidak tergantung dari penciptanya, karena pendaftaran berakibat bahwa orang yang mendaftarkannya dianggap sebagai pihak yang memiliki hak eksklusif berdasarkan pada Pasal 35 (4) Undang-Undang nomor 19 tahun 2002. Sistem deklaratif dalam hak cipta hanya mengakui seolah-olah yang mendaftarkan sebagai pemiliknya, selama belum terbukti sebaliknya. Sistem deklaratif dalam hak cipta juga mempunyai sifat pendaftaran secara pasif, karena perlindungan ada tanpa harus didaftarkan, sehingga sejalan dengan Pasal 36 Undang-Undang Nomor 19 tahun 2002 tentang hak cipta bahwa Ditjen HKI tidak bertanggung jawab atas isi, maksud, bentuk ciptaan yang didaftarkan. Hal tersebut sudah terdapat dalam putusan mahkamah agung sehingga putusan makamah agung sudah menerapkan sistem deklaratif dalam hak cipta. |
| Abstrak (Inggris) | Every people have an idea or concept for every creation that have been created. An invention have a right to get protection, both of morality right or economy right. The protection that give from Law no. 19 year 2002 about copyright is given when invention has been born or completed, based on declaratie system adopted by the copyright, that copyright protection born automatically after the creation has been completed, because who creates the creation first then he is the creator. This study aims to determine the application of Article 35, paragraph 4 jo article 36 of law no. 19 year 2002 about copyright in the Supreme Court decision number 658/K/PDT.SUS/2012. To achieve this goal then peneletian performed using normative juridical approach. Secondary data are collected and processed, presented, and analyzed qualitatively with the presentation of narrative text data. The result suggest that, declarative system in copyright is facultative that is somebody may register the creation or not depent on the creator it self, because registration result that people who register are considered as having the exclusive right based on Article 35, paragraph 4 of law no. 19 year 2002. Declarative system in copyright only recognize as if the register as owner, as long as not proven otherwise. Declarative system in copyright also have a passive registration, because there is no need to be registered for have the protection, thus in line with Article 36 of law no. 19 year 2002 about copyright that Directorate Generel of HKI is not responsible for the content, purpose, and form creation that have been registered. It is already contained in thedecision of the Supreme Court that the decision of the Supreme Court has implemented a declarative system in copyright. |
