| Abstrak | Dalam sistem pengangkutan tidak hanya mengangkut penumpang tetapi juga pengangkutan barang paket. Pelayanan paket di Indonesia dapat dilakukan melalui badan usaha angkutan multimoda nasional dengan menggunakan alat angkut sendiri dan/atau moda transportasi lain. Dalam penyelenggaraan pengangkutan kadang timbul kerugian, berupa barang hilang rusak atau terlambat, apabila terjadi kerugian yang disebabkan moda trasportasi lain maka timbul pertanyaan pihak mana yang harus bertanggung jawab sehingga dapat dirumuskan masalah berupa bagaimana tanggung jawab hukum PT. TIKI Jalur Nugraha Ekakurir Purwokerto selaku pengusaha multimoda apabila terjadi kerugian yang disebabkan oleh kesalahan moda transportasi lain? Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan legis positivis, spesifikasi deskriptif, lokasi penelitian di PT.TIKI Jalur Nugraha Ekakurir Purwokerto, data berupa data sekunder, metode analisa menggunakan metode normatif kualitatif yaitu data yang diperoleh dianalisa berdasarkan hukum yang relevan dengan masalah dan didukung dengan doktrin. Dari hasil penelitian dan pembahasan diperoleh jawaban masalah sebagai berikut: • PT. TIKI Jalur Nugraha Ekakurir Purwokerto bertanggung jawab terhadap pengirim atas kerugian yang timbul akibat kesalahan PT. KAI hal ini sesuai penjelasan Pasal 1 PP Nomor 8 Tahun 2011 tentang Angkutan Multimoda. • PT. TIKI Jalur Nugraha Ekakurir memberikan ganti kerugian sebesar 10 kali biaya kirim, hal ini tidak sesuai dengan ketentuan Pasal 193 ayat (2) Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan Pasal 158 ayat (3) Undang-Undang No. 23 Tahun 2007 tentang Perkeretaapian. • Jangka waktu mengajukan ganti kerugian yang diberikan PT. TIKI Jalur Nugraha Ekakurir adalah 14 hari, hal ini tidak sesuai dengan ketentuan pasal 95 ayat (1) KUHD . |

Multimodal transport in organizing transport can use their own means of transport and other modes of transportation. In the operation of the transport times of loss, in the form of damaged or lost goods too late, in the event of losses caused other modes of transportation, the question arises as to who should be responsible so that it can be formulated problem of how the legal responsibility of PT. TIKI Line Nugraha Ekakurir Purwokerto as multimodal employers in the event of losses caused by errors in other modes? The method used in this research is normative juridical approach to legis positivist, descriptive specification, research sites in PT.TIKI Strip Ekakurir Purwokerto Nugraha, the data in the form of secondary data analysis method using qualitative normative method is data obtained were analyzed based on the relevant legal issues and supported by doctrine. From the results of research and discussion obtained answers the following issues: • PT. TIKI Line Nugraha Ekakurir Purwokerto responsible shipper for losses incurred due to errors PT. KAI it is appropriate explanation of Article 1 of Regulation No. 8 of 2011 on Multimodal Transport which states multimodal transport agreement using a multimodal transport document, in this case is PT. TIKI Line Nugraha Ekakurir as publisher document so that the sender can not claim damages directly against PT. KAI because there is no contractual relationship between the sender with PT. KAI. • PT. TIKI Line Nugraha Ekakurir provide compensation amounting to 10 times the cost of shipping, it is not in accordance with the provisions of Article 193 paragraph (2) of Law No. 22 of 2009 on Road Traffic and Road Transport Article 158 paragraph (3) of Law No. 23 Year 2007 on Railways which states should compensation be calculated based on the actual loss suffered. • Duration filed compensation given PT. TIKI Line Ekakurir Nugraha is 14 days, this is not in accordance with the provisions of Article 95 paragraph (1) KUHD the time limit to file compensation for 1 year. |
