| Abstrak | PEMBATALAN PERKAWINAN KARENA PERJODOHAN (Tinjauan Yuridis Terhadap Putusan Pengadilan Agama Klaten Nomor 1221/Pdt.G/ 2018/PA.Klt.) Oleh: WULAN SETYANI E1A016208 ABSTRAK Pasal 1 Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan menyatakan bahwa Perkawinan ialah ikatan lahir bathin antara seorang pria dengan seorang wanita sebagai suami-isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Namun kekal tersebut bisa saja tidak terjadi karena adanya pembatalan perkawinan. Rumusan masalah dalam penelitian ini adalah bagaimana pertimbangan hukum hakim dalam mengabulkan permohonan pembatalan perkawinan karena perjodohan pada Putusan Pengadilan Agama Klaten Nomor 1221/Pdt.G/2018/PA.Klt. Metode yang digunakan dalam penelitian ini adalah yuridus normatif, spesifikasi penelitian prespektif analisis, teknik pengumpulan data studi keperpustakaan dengan inventarisasi, data yang terkumpul kemudian disajikan dalam bentuk teks naratif dan analisis normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan terhadap putusan Pengadilan Agama Klaten dengan putusan Nomor 1221/Pdt.G/2018/PA.Klt dapat disimpulkan bahwa pertimbangan hukum hakim menggunakan Pasal 37 Peraturan Pemerintah Nomor 9 Tahun 1975 jo Pasal 72 huruf (b) Kompilasi Hukum Islam dan Pasal 23 huruf (d) Undang-Undang nomor 1 Tahun 1974 jo pasal 73 huruf (b) Kompilasi hukum Islam serta Pasal 72 huruf (b) Kompilasi hukum islam. Penulis berpendapat hendaknya hakim mengacu pada Pasal 23 huruf (b) Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan jo Pasal 73 huruf (b) Kompilasi Hukum islam dan Pasal 72 ayat (2) Undang-Undang Nomor 1 Tahun 1947 Tetang Perkawinan jo Pasal 27 ayat (2) Kompilasi Hukum Islam serta hakim dalam pertimbangan hukum melakukan mediasi dapat mencantumkan Peraturan Mahkamah Agung Nomor 1 Tahun 2016 Tentang Prosedur Mediasi Di Pengadilan. | Abstrak (Inggris) | CANCELLATION OF MARRIAGE DUE TO ADMINISTRATION (Judicial Review of the Decision of the Klaten Religious Court Number 1221 / Pdt.G / 2018 / PA.Klt.) By: WULAN SETYANI E1A016208 ABSTRACT Article 1 of Law Number 1 of 1974 concerning Marriage states that marriage is a physical and mental bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family (household) based on Almighty God. However, this permanence may not occur because of the cancellation of the marriage. The formulation of the problem in this study is how the judges' legal considerations in granting a marriage cancellation request due to matchmaking in the Klaten Religious Court Decision Number 1221 / Pdt.G / 2018 / PA.Klt. The method used in this research is juridus normative, analysis perspective research specification, library study data collection techniques with an inventory, the data collected is then presented in the form of narrative text and qualitative normative analysis. Based on the results of research and discussion of the decision of the Klaten Religious Court with decision Number 1221 / Pdt.G / 2018 / PA.Klt, it can be concluded that the judges' legal considerations used Article 37 of Government Regulation Number 9 of 1975 in conjunction with Article 72 letter (b) Compilation of Islamic Law and Article 23 letter (d) Law number 1 of 1974 jo Article 73 letter (b) Compilation of Islamic law and Article 72 letters (b) Compilation of Islamic law. The author is of the opinion that the judge should refer to Article 23 letter (b) of Law Number 1 of 1974 concerning Marriage in conjunction with Article 73 letter (b) Compilation of Islamic Law and Article 72 paragraph (2) of Law Number 1 Year 1947 Regarding Marriage in conjunction with Article 27 Paragraph (2) The compilation of Islamic Law and judges in legal considerations to conduct mediation may include Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures in Courts.
