| Abstrak | TINJAUAN YURIDIS TERHADAP PERBUATAN MELAWAN HUKUM DALAM PELAKSANAAN EKSEKUSI HAK TANGGUNGAN (Studi Terhadap Putusan Nomor: 2367 K/Pdt/2018) oleh: Bonny Adam Samudera E1A114103 ABSTRAK Salah satu ciri dari hak tanggungan adalah mudah dan pasti dalam pelaksanaan eksekusinya, apabila di kemudian hari debitur wanprestasi. Eksekusi hak tanggungan yaitu apabila debitur cidera janji, objek hak tanggungan dijual melalui pelelangan umum menurut cara yang ditentukan dalam peraturan perundang-undangan yang berlaku dan pemegang hak tanggungan berhak mengambil seluruh atau sebagian dari hasilnya untuk pelunasan piutangnya, dengan hak mendahului daripada kreditur-kreditur lain. Tujuan penelitian ini menganalisis unsur-unsur Perbuatan Melawan Hukum terhadap pelaksanaan eksekusi Hak Tanggungan dalam Perkara Nomor: 2367 K/Pdt/2018 dan menganalisis dasar dan alasan yudex factie dan yudex yurist dalam menetapkan ada dan tidaknya Perbuatan Melawan Hukum dalam Perkara Nomor: 2367 K/Pdt/2018. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan perundang-undangan, data-data sekunder yang terkumpul diolah, disajikan dalam bentuk teks naratif dan dianalisis dengan metode analisis normatif kualitatif. Hasil penelitian menunjukkan bahwa unsur-unsur Perbuatan Melawan Hukum terhadap pelaksanaan eksekusi Hak Tanggungan dalam Perkara Nomor: 2367 K/Pdt/2018 adalah bertentangan dengan kewajiban hukum si pembuat karena melanggar Pasal 36 Peraturan Menteri Keuangan Nomor 93/PMK 06/2010 tentang Petunjuk Pelaksanaan Lelang. Dasar dan alasan Yudex Factie menetapkan adanya perbuatan melawan hukum yaitu bertentangan dengan kewajiban hukum si pembuat karena melanggar Pasal 36 Peraturan Menteri Keuangan Nomor 93/PMK06/2010 tentang Petunjuk Pelaksanaan Lelang dan sesuai dengan Pasal 1365 KUH Perdata. Dasar dan alasan Yudex Yurist menetapkan tidak ada perbuatan melawan hukum, yang ada Debitur wanprestasi sehingga Bank selaku Kreditur berwenang dalam melakukan lelang eksekusi objek Hak Tanggungan sesuai dengan ketentuan Pasal 6 UUHT. | Abstrak (Inggris) | JURIDICIC REVIEW OF THE ACTION AGAINST THE LAW IN THE IMPLEMENTATION OF RIGHTS EXECUTION (Study of Decisions Number: 2367 K / Pdt / 2018) by: Bonny Adam Samudera E1A114103 ABSTRACT One of the characteristics of the mortgage is easy and indisputable in the implementation of its execution, if the debtor breaks the agreement (dutch: wanprestasi) later. Execution of mortgage rights, is when the debtor breaks the agreement, the object of the mortgage is sold through a common bidding according to the specified laws and regulations and the mortgage right holder has the right to take the whole party or just a few part of the proceeds for repayment of the assets, with the right to overtake other creditors. This research focuses on Juridical Review of the action against the law in the Execution of Mortgage Rights (Study of Decision Number: 2367 K / Pdt / 2018) and analyze the basis and the reason of Yudex Factie and Yudex Yurist to decide the state of the action against the law in case number : 2367 K/Pdt/2018. The research method used is normative juridical, with the legal approach, collected secondary data were processed, then presented in the form of narrative texts and finally analyzed with qualitative normative analysis methods. The result shows there are several elements of illegal actions towards the Implementation of Mortgage Rights Execution in Case No.: 2367 K/Pdt/2018 is not in accordance with Article 36 of the Minister of Finance Regulation Number 93/PMK06/2010 about Bidding Implementation Guidelines. Legal basis and reason of Yudec Factie declared there is an act against the law which the act is in the contrary on the perpetrator’s legal obligation since it is against the Article 36 of the Minister of Finance Regulation Number 93/PMK06/2010 about Bidding Implementation Guidelines also in the Article 1365 BW. Legal Basis and reason of Yudex Yurist declared the absence of the act against the law, since the Debtor breaks the agreement (dutch: wanprestasi), thus Bank as the creditor is authorized to carry out the execution of the mortgage right object in accordance with article 6 UUHT.
