| Abstrak | Judi yang memainkan angka-angka dengan sejuta impian dan harapan yang cukup besar untuk memperoleh keuntungan ini tercatat sudah meracuni masyarakat luas baik dari kalangan menengah hingga kalangan bawah. Jenis perjudian yang paling marak saat ini yang dilakukan oleh masyarakat adalah kegiatan permainan judi togel (toto gelap). Penelitian ini bertujuan untuk mengetahui penerapan unsur - unsur tindak pidana memberi kesempatan kepada khalayak umum untuk permainan judi dan untuk mengetahui dasar pertimbangan hukum hakim dalam menjatuhkan pidana terhadap terdakwa, dengan menggunakan metode pendekatan yuridis normatif. Spesifikasi penelitian deskriptif analisis, Sumber data sekunder berupa Putusan Pengadilan Negeri Purwokerto Nomor 137/Pid.B/2019/PN Pwt. Berdasarkan hasil penelitian diketahui, Majelis Hakim sudah tepat menerapkan Pasal 303 Ayat (1) ke-2 Kitab Undang-undang Hukum Pidana (KUHP), perbuatan terdakwa telah terbukti sah dan menyakinkan memenuhi semua unsur dalam pasal tersebut. Terdakwa sebagai subjek hukum telah melakukan perbuatan pidana, dengan sengaja menawarkan atau memberi kesempatan kepada khalayak umum untuk bermain judi Togel jenis Hongkong, permainan judi tersebut bersifat illegal yang artinya terdakwa tidaklah memiliki ijin dari pihak yang berwenang. Dasar pertimbangan hukum hakim dalam menjatuhkan pidana terhadap terdakwa, yaitu : a) Pertimbangan terhadap unsur - unsur Pasal 303 Ayat (1) ke-2 Kitab Undang-undang Hukum Pidana (KUHP), b) Pembuktian berdasarkan alat-alat bukti sebagaimana diatur dalam Pasal 184 KUHAP, alat bukti dimaksud dalam perkara ini adalah keterangan saksi dan keterangan terdakwa, c) pertimbangan berdasarkan ketentuan Pasal 197 ayat (1) huruf f KUHAP yaitu : tentang hal-hal yang memberatkan dan meringankan terdakwa. Majelis Hakim Menjatuhkan pidana terhadap terdakwa tersebut dengan pidana penjara selama 7 (tujuh) bulan; Menetapkan Terdakwa tetap ditahan. |

The type of gambling that is currently most prevalent by the public is the gambling game activity of lottery (dark toto). This study aims to determine the application of the elements of a criminal act to give the general public the opportunity to play gambling and to find out the legal basis for judges in imposing crimes against the accused, using the normative juridical approach. Descriptive analysis research specification, secondary data source in the form of Purwokerto District Court Decision Number 137 / Pid.B / 2019 / PN Pwt. Based on the results of the research, it is known that the Panel of Judges has correctly implemented Article 303 Paragraph (1) of the Criminal Code (KUHP), the actions of the defendant have been proven valid and convincingly fulfilled all the elements in the article. The defendant as a legal subject had committed a criminal act, deliberately offering or giving the public the opportunity to play Togel type Hong Kong gambling, the gambling game was illegal, which means that the defendant did not have permission from the authorized party. The legal basis for the judge's legal consideration in imposing a crime against the accused, namely: a) Consideration of the elements of Article 303 Paragraph (1) 2nd of the Criminal Code (KUHP), b) Evidence based on evidence as provided for in Article 184 KUHAP, the evidence referred to in this case is the testimony of the witness and the testimony of the defendant, c) considerations based on the provisions of Article 197 paragraph (1) letter f of the Criminal Procedure Code, namely: concerning matters that incriminate and lighten the defendant.
