| Abstrak | Terjadi pergeseran pandangan terhadap alat bukti seiring dengan perkembangan teknologi informasi. Pasal 5 ayat (2) Undang-Undang Nomor 11 Tahun 2008 mengatur bahwa Informasi Elektronik dan/atau Dokumen Elektronik dan/atau hasil cetaknya merupakan perluasan dari alat bukti yang sah. Perluasan ini dapat diartikan bahwa Informasi Elektronik dan/atau Dokumen Elektronik menambah atau memperluas cakupan alat bukti yang telah diatur. Salah satu contoh Informasi Elektronik tersebut adalah Log File, yaitu file yang mencatat akses pengguna pada saluran akses operator atau penyelenggara jasa akses. Berdasarkan uraian tersebut maka penulis tertarik untuk mengadakan penelitian yang berjudul “Peranan Log File dalam Pembuktian Tindak Pidana Penggelapan (Tinjauan Yuridis Terhadap Putusan Pengadilan Negeri Denpasar Nomor: 825/Pid.B/2012/PN.Dps)” Berdasarkan latar belakang yang telah diuraikan di atas, maka disusun pokok permasalahan, pertama apakah Log File dapat digunakan sebagai alat bukti untuk pembuktian tindak pidana? Kemudian yang kedua, bagaimanakah peranan Log File dalam pembuktian tindak pidana penggelapan dalam Putusan Nomor: 825/Pid.B/2012/PN.Dps? Spesifikasi penelitian ini menggunakan spesifikasi penelitian perskriptif, yaitu suatu penelitian untuk mendapatkan saran-saran mengenai apa yang harus dilakukan untuk mengatasi masalah tertentu. Peranan Log File dalam pembuktian Tindak Pidana Penggelapan dalam Putusan Nomor: 825/Pid.B/2012/PN.Dps adalah memberikan kronologis awal dari kasus ini kepada Hakim. Yaitu terdakwa memiliki ID pelanggan indonetwork yang mengiklankan jasa ekspedisi fiktif yang dikunjungi oleh korban. Dari iklan tetsebut korban dan terdakwa sepakat mengirimkan sejumlah buku. Namun terdakwa menggelapkan buku tersebut beserta uang pembayaran pengiriman. Selain itu, Log File juga menambah keyakinan Hakim bahwa memang benar ID indonetwork itu memang terdakwa. |

Article 5 paragraph (2) of “Undang-Undang Nomor 11 Tahun 2008” regarding Information and Electronic Transactions have adjust that Electronic Information and/or Electronic Document and/or the printout is an extension of the valid legal evidence. The expansion here can be interpreted that the Electronic Information and/or Electronic Document add or expand the scope of evidence. One example is the Electronic Information Log Files in Internet network, which is a file that records user access on the access channel operators/access service providers. Based on these descriptions, the writer is interested in conducting a study titled "The Role of Evidence Log Files in the Crime of Embezzlement (Judicial Review Against Verdict of “Pengadilan Negeri Denpasar” Number: 825/Pid.B/2012/PN.Dps)" Based upon the description above, it can be formulated problems, first whether the log file can be used as evidence in proving a criminal offense? Then the second , how the role of Log Files in proving the crime of embezzlement in Verdict Number: 825/Pid.B/2012/PN.Dps? This study uses research prescriptive specification , namely a study to get suggestions on what to do to solve a particular problem , the source of the data used in this study is a secondary data source . Role of Log Files in the Crime of evidence in Verdict Number: 825/Pid.B/2012/PN.Dps is provide information to the judge about the early chronological of this case. Namely that the defendant has a indonetwork’s customer ID who advertise services fictitious delivery service visited by the victim through the internet. And then the victim and the defendant agreed to send out a number of items such as books. However, the book was finally accused of embezzling along with payment on delivery. And also adds to the belief for judge that the defendant has a indonetwork’s customer ID. |
