| Abstrak | Penelitian yang berjudul “Peran Organisasi Justice Without Borders (JWB) dalam Memperjuangkan Kaum Pekerja Migran di Indonesia pada tahun 2017-2019” ini bertujuan untuk mengetahui dan mendeskripsikan peran peran politik dan hukum organisasi Justice Without Borders (JWB) dalam memperjuangkan Pekerja Migran Indonesia (PMI) yang mengalami pelanggaran HAM pada tahun 2017-2019. Selain itu, penelitian ini juga bertujuan untuk memahami dan menjelaskan pola hubungan negara dan organisasi Justice Without Borders (JWB) dalam memperjuangkan buruh migran Indonesia. Penelitian ini dilandasi oleh paradigma konstruktivisme dan perspektif strukturalis. Metode penelitian yang digunakan adalah metode penelitian kualitatif dengan pendekatan fenomologi. Data dalam penelitian ini dikumpulkan dengan cara observasi, wawancara mendalam, dan dokumentasi. Sementara, teknik yang digunakan untuk menganalisa data melalui model analisis data interaktif Miles dan Huberman, yaitu pengumpulan data, reduksi data, penyajian data, dan penarikan kesimpulan Hasil penelitian ini menjelaskan bahwa peran politik organisasi Justice Without Borders (JWB) dilakukan melalui pendampingan dalam menuntut hak para buruh migran yang belum terpenuhi, melakukan kegiatan penyadaran kepada para buruh migran melalui pelatihan paralegal, membangun kemitraan dengan LSM-LSM lokal dan Pemerintah Indonesia guna mempermudah akses dalam menyelesaikan permasalahan para buruh migran. Peran hukum organisasi JWB melalui pengecekan data, legalitas klien, dengan memerhatikan jangka waktu kasus para buruh migran dan menyediakan pengacara pro bono untuk membantu proses hukum para buruh migran. Selain itu, pola hubungan yang terbangun antara JWB dengan Pemerintah Indonesia adalah pola hubungan kolaboratif. Artinya, hubungan atau relasi yang terjadi antara JWB dengan Pemerintah Indonesia berada pada posisi seimbang yang sama-sama memperdulikan hak-hak pekerja migran Indonesia. Dalam hal ini, pola hubungan antara JWB dengan Pemerintah Indonesia memiliki pola hubungan yang saling berkaitan. Dengan demikian JWB berperan sebagai intermediary actor bagi negara dan warga negaranya serta dengan negara tempat warga negaranya bekerja. |
| Abstrak (Inggris) | The research entitled: "The Role of the Justice Without Borders (JWB) Organization in Fighting Migrant Workers in Indonesia in 2017-2019" aims to identify and describe the role of the Justice Without Borders (JWB) organization in fighting for you migrant workers in Indonesia in 2017-2019, as well as knowing the political and legal role of the Justice Without Borders (JWB) organization in fighting for migrant workers in Indonesia in 2017-2019. Lack of job opportunities and high unemployment during the economic crisis have prompted Indonesian workers to seek work abroad. So that for some of the Indonesian people the best solution is to become a migrant worker as an effort to improve the standard of living of their families. Unfortunately, this is also directly proportional to the number of cases of migrant workers in Indonesia. So the establishment of the Justice Without Border (JWB) organization to help and fight for migrant workers in Indonesia. This research is based on constructivism paradigm and structuralist perspective. The research method used is a qualitative research method with a phenomenological approach. The data in this study were collected by means of observation, in-depth interviews, and documentation. Meanwhile, the technique used to analyze the data is through Miles and Huberman's interactive data analysis model, namely data collection, data reduction, data presentation, and conclusions. This research is based on constructivism paradigm and structuralist perspective. The research method used is a qualitative research method with a phenomenological approach. The data in this study were collected by means of observation, in-depth interviews, and documentation. The results of this study explain that the political role of the Justice Without Borders (JWB) organization is carried out through assistance in demanding the rights of migrant workers who have not been fulfilled, carrying out awareness activities for migrant workers through paralegal training, building partnerships with local NGOs and the Government of Indonesia to facilitate access in solving the problems of migrant workers. The legal role of the JWB organization is through checking data, client legality, taking into account the timeframe for cases of migrant workers and providing pro bono lawyers to assist with legal processes for migrant workers. In addition, the relationship pattern that has been developed between JWB and the Government of Indonesia is a collaborative relationship pattern. This means that the relationship or relationship that occurs between JWB and the Government of Indonesia is in a balanced position that both cares about the rights of Indonesian migrant workers. In this case, the relationship pattern between JWB and the Government of Indonesia has a pattern of interrelated relationships. Thus JWB acts as an intermediary actor for the state and its citizens as well as with the country where its citizens work. |
